From hereby forth, Boxdetail will be known as 'The Company'.

All services provided by Boxdetail may be used for lawful purposes only. Transmission, storage or presentation of any information, data or material that are deemed unlawful under Singapore Law is prohibited. This includes but is not limited to: copyrighted materials, pornography, email blasting and hosting of illegal softwares.

We will make every reasonable attempt to avoid unexpected server downtime and to ensure that all hosting accounts and dedicated servers are well taken care of. All hosting account and dedicated server data backups are the account holder's responsibility. Although we do make regular system-wide backups (of our hosting account servers), The Company is NOT responsible for data backup integrity or subsequent loss. Shared hosting accounts and dedicated servers should not be used for mission critical websites or email that require absolute redundancy. By using our services, you agree that you will make no claim or attempt to collect for reimbursement of any financial loss or hardship related to using these services. If you need fail safe hosting services, contact us for special arrangements and related contracts.

Violation of the Terms of Services will be grounds for immediate account termination. Accounts hogging excessive server resources, to slow or crash a server, will be suspended immediately. If an account is suspended due to server resource issues, we will (upon request) make a reasonable effort to help get the account unsuspended. The Company will not debug your software programs or spend time tracking down why your account was causing problems. All server activity is logged. Any snooping, hacking, or other inappropriate activity of any type outside of your account's root path, on our servers, will be grounds for termination. Hosting accounts are suspended immediately if an invoice goes 5 days past due date. If you need to make payment arrangements, would like to extend the grace period or if you account has been suspended, you are to contact us immediately.

All services provided by Boxdetail may only be used for lawful purposes. The laws of the State of Indiana and the United States of America apply. The customer agrees to indemnify and hold harmless Boxdetail from any claims resulting from the use of our services. Use of our services to infringe upon any copyright or trademark is prohibited. This includes but is not limited to unauthorized copying of music, books, photographs, or any other copyrighted work. The offer of sale of any counterfeit merchandise of a trademark holder will result in the immediate termination of your account. If you believe that your copyright or trademark is being infringed upon, please email abuse@MDDHosting.com with the information required. A list of required information may be found here. If the request is of a licensing issue, we may require further documentation. Examples of unacceptable material on all Shared, Reseller, Semi-Dedicated and Dedicated Servers include: IRC Bots, Proxy Scripts / Anonymizers, Pirated Software / Warez, imagedumps (similar to photobucket), filedumps, RapidLeech (similar to rapidshare), or banner-ad services such as commercial banner ad rotation, commercial audio streaming (more than one or two streams), Escrow, High-Yield Interest Programs(HYIP) or related sites, Investment sites (FOREX, egold exchange), sale of any controlled substance without prior proof of appropriate permit(s), AutoSurf sites, Bank Debentures, Bank Debenture Trading Programs, Prime Banks Programs, lottery sites, muds / rpg's, hate sites, hacker focused sites/archives/programs, or sites promoting illegal activities, IP Scanners, Brute Force Programs, Mail Bombers and Spam Scripts. Forums that distribute or link to warez content is prohibited. Acceptable material on Dedicated Servers: Proxy Scripts / Anonymizers, Image Hosting sites, sites with pornographic material, and muds / rpg's We reserve the right to refuse service to anyone. Any material that, in our judgment, is obscene or threatening is prohibited and will be removed from our servers with or without notice. Failure to respond to email from our abuse department within 24 hours may result in the suspension or termination of your services. All abuse issues must be dealt with via troubleticket/email and will have a response within 24 hours. If in doubt regarding the acceptability of your site or service, please contact us at abuse@boxdetail.com and we will be happy to assist you. Potential harm to minors is strictly forbidden, including but not limited to child pornography or content perceived to be child pornography (Lolita): Any site found to host child pornography or linking to child pornography will be suspended immediately without notice. Resellers: we will suspend the site in question and will notify you so you may terminate the account. We will further monitor your activity; more than one infraction of this type may result in the immediate termination of your account. Direct customers: Your services will be terminated with or without notice. Violations will be reported to the appropriate law enforcement agency. It is your responsibility to ensure that scripts/programs installed under your account are secure and permissions of directories are set properly, regardless of installation method. When at all possible, set permissions on most directories to 644 or as restrictive as possible. Users are ultimately responsible for all actions taken under their account. This includes the compromise of credentials such as username and password. It is required that you use a secure password. If a weak password is used, your account may be suspended until you agree to use a more secure password. Audits may be done to prevent weak passwords from being used. If an audit is performed, and your password is found to be weak, we will notify you and allow time for you to change/update your password.

The Company takes a very serious stand when it comes to unsolicited e-mails being sent out of our servers. Accounts caught sending unsolicited e-mails or usenet postings, either through our servers or to promote a website on our servers will be terminated immediately and will not qualify for a refund. Accounts terminated for sending unsolicited e-mail or usenet posts give up all right to any content, files, backups and technical support associated with any and all accounts hosted on the Company's servers and network. Account holders may not create e-mail forwards which forwards to an e-mail address not accessible by the account holder, unless the recipient has specifically consented for the account holder to do so. The Company reserves the right to investigate accounts accused of sending unsolicited e-mails, or usenet postings, in any way deemed necessary. This includes suspending the accused account, during investigation.

This Terms of Service agreement may be amended, at any time, at the discretion of the Company. Notification of amendments will be e-mailed to the address given during account signup. All accounts are required to comply with any changes made to these policies unless an account cancellation is requested within 10 days of the Terms of Service amendment. Account holders are required to keep a valid and current email address on file with us. We are not responsible for lost or misdirected e-mail.
